Terms of Use

Welcome to The Zone.  The following Terms of Use (“Terms”) govern your access to and use of The Zone platform and app.  Please read these Terms carefully.  

 

The Zone is not a mental health care provider, is not intended to provide mental health treatment or support, and instead is for general wellbeing and awareness.  Do not use this service for emergency medical needs.  If you are in crisis or think you may have an emergency, call 911 or your doctor immediately.  If you are having thoughts of harming yourself or others, or think that you or another person may be in danger, call 911 or 1-800-273-TALK (8255) to speak with a skilled, trained counselor at any time (National Suicide Prevention Lifeline). If you are located outside the United States, call your local emergency line immediately. 

 

THIS AGREEMENT

 

This Terms of Use agreement applies to individual users through their school’s subscription with The Zone.  The words “you,” “your” and “student” are used interchangeably here to refer to the individual user of The Zone (whether a student, coach or other user).  The school that subscribes to The Zone to enable individual users to access The Zone is referred to here as “your school” and the “subscribing school.”

 

By accessing and using The Zone, you agree to comply with and be bound by all the terms and conditions described in these Terms.  If you do not agree to all these terms and conditions, you are not authorized to use The Zone.

 

THE ZONE CONTENT

 

The Zone is intended to be a tool to help you gain insight regarding your emotions and mental wellbeing.  We offer guided self-reflections with our curated writing prompts of over 300+ questions, as well as machine learning algorithms to provide you additional content suggestions related to your self-reflections.  The Zone is not a clinical or medical device or provider, and should not be used to diagnose, prevent, monitor, treat or alleviate any mental health condition.  

 

The contents of The Zone, including text, graphics, images, and other material, are for informational purposes only. The content is not intended to be a substitute for professional advice, diagnosis, monitoring or treatment. Always seek the advice of a mental health professional or other qualified health provider with any questions you may have regarding your mental or physical health. Never disregard professional advice or delay in seeking it because of your interaction with, or something you have read on, The Zone.

 

By using The Zone you acknowledge and agree that the information on The Zone is not and should not be considered medical advice.  You should always talk to an appropriately qualified medical professional for diagnosis and treatment.  None of the content represents or warrants that any advice or recommendations here are safe, appropriate or effective for you.  The Zone is merely one tool to help you track your own feelings and impressions in a limited way and to get certain information; The Zone encourages you to seek additional support for your mental wellbeing from qualified professionals, your school, and others as appropriate.


 

IMPORTANT INFORMATION ON PRIVACY, DISCLOSURE AND ESCALATION:

 

Your privacy, and also your safety and wellbeing, are important to us.  By using The Zone you agree to provide contact information that we can share with your school under the limited circumstances below.  You also acknowledge and agree to The Zone’s disclosure and escalation protocols, as follows:

 

  • The data you enter into the app is encrypted and kept anonymous from your school, except as noted below.  Your school will receive aggregated and anonymized data regarding students’ input and engagement with the app.  (For example, your school will receive information regarding the number of students using the app, the percentage of students reporting they are feeling “great” or “not great,” on a given day, etc.)  We use a minimum aggregation threshold of 10 individuals, meaning that we only consider data to be aggregated and anonymized if it pertains to a group of at least 10 individuals.  

 

  • If you enter in the app four times (4x) or six times (6x) in a two-week period that you feel “not great,” then The Zone will ask you if you want help reaching out to your school to schedule an appointment with someone at the school.  If you answer yes, The Zone will provide an email template that you can use to reach designated people at your school.  If you answer no, then The Zone would not disclose your identity to the school at that time.  

 

  • If you enter in the app that you are feeling “not great” 10 times (10x) in a two-week period, then under these Terms of Use you automatically consent that The Zone can disclose your identity and contact information to your school point(s) of contact, with the information that you indicated you are feeling “not great” 10x within two weeks, so your school can contact you directly.  The Zone is only a conduit for helping you collect and receive information, and is not a mental health provider.  We provide this information to your school to help you engage directly with your school’s point(s) of contact.  

 

  • The Zone is not a mental health provider, is not intended to provide mental health treatment or support, and instead is for general wellbeing and awareness.  Entering “not great” 4x, 6x or 10x in a two-week period is not a clear or specific number for action, and you may benefit in seeking help and support far sooner.  We have chosen to make the described and limited disclosure to the school in those circumstances to help support safety and wellbeing by referring you to receive additional support from your school, while also balancing user’s confidentiality and privacy concerns.  

 

  • These protocols are in no way intended to suggest that you should wait until a certain point to reach out for direct contact with your school or a qualified mental health professional; The Zone encourages you to do so as often and as early as may be helpful to you.  

 

  • The Zone has no responsibility for the actions, inactions, communications or interactions between you and your school or mental health providers.  The Zone is not and should not be considered a medical or mental healthcare provider and information on The Zone is not medical or mental health advice, counseling, diagnosis, monitoring or treatment.  

 

  • Your school designates points of contact who will receive the above mentioned information from The Zone when the escalation protocol is triggered (upon your entering 10x “not great” in two weeks under the protocols described in these Terms).  The Zone has no responsibility for your school’s privacy policy or response to notice from The Zone.  The Zone has no responsibility for the actions, inactions, communications and interactions between you and your school or others.

The Zone does not recommend or endorse any clinicians, counselors, psychiatrists, social workers, physicians, products, procedures, opinions, or other information that may be mentioned on The Zone. Reliance on any information provided by The Zone, our employees, or others appearing on the website at the invitation of The Zone, other visitors to The Zone, or connections by The Zone to your school’s providers, is solely at your own risk.

 

ACCEPTABLE USE

 

You agree not to use The Zone in an unlawful way or for an unlawful or illegitimate purpose or in any manner that contravenes these terms.  You shall not attempt to disrupt the operation of The Zone by any method, and shall not use The Zone in any manner that could damage, disable, or impair the functioning or content of The Zone.  You shall not attempt to gain unauthorized access to any user accounts or computer systems or networks, or use the identity of other students or subscribers to access The Zone.

 

DISPUTES

 

You agree that any claim, cause of action or dispute you have with us regarding these Terms of Use or The Zone would be brought only in a state or federal court located in New York.  The laws of the State of Delaware will govern this Privacy Policy as well as any claim that might arise between you and us, without regard to conflict of law provisions.

By using The Zone you acknowledge and agree to The Zone’s Privacy Policy, which is hereby incorporated as part of these Terms of Use, and is available here.
